Learn to read and understand Mexico's customs declaration (pedimento): from header data to line items, duties, and the fields that determine your tax and customs obligations.
The pedimento is Mexico's official customs declaration through which goods entering or leaving national territory are declared to customs authorities. It is the equivalent of the customs declaration that exists in all countries, but with characteristics unique to the Mexican customs system. It is regulated by Article 36 of the Customs Law (Ley Aduanera), and its format is defined in Annex 22 of the General Rules for Foreign Trade (RGCE).
The pedimento serves multiple functions: it is the basis for calculating and paying foreign trade taxes (import duty, customs processing fee, VAT, excise taxes), it is the statistical control document for authorities, it serves as the fiscal receipt for the operation, and it is the legal instrument supporting the lawful presence of goods in Mexican territory. Without a duly processed and paid pedimento, goods cannot be released from customs.
Mexico processes more than 15 million pedimentos per year. Each pedimento generates a unique number that identifies it throughout its fiscal life (5 years). This number is essential for subsequent consultations, audits, and any procedures related to the operation.
The pedimento is divided into four main sections, each containing specific information that together completely describes the customs operation. Understanding this structure is fundamental for any foreign trade professional, as it allows quick identification of relevant data and detection of potential errors.
The pedimento format is standardized by Annex 22 of the RGCE, which establishes 28 fields in the header and multiple fields for each line item. Although the pedimento is processed electronically through the SAAI system (Automated Customs System), importers and exporters receive a printed or PDF representation that they should carefully review before authorizing its validation.
The pedimento header contains the operation's general data. Each field has an assigned number in Annex 22 and a specific meaning. The most relevant fields for the importer are as follows.
Fields 19 through 28 detail the customs value components. It is crucial to understand that all these fields are expressed in national currency (Mexican pesos), except Field 12 which is in US dollars. The fields include: insurance value (19-20), freight (21), packing (22), other additions (23), and deductions for transport (24), insurance (25), loading (26), unloading (27), and others (28).
The applicable exchange rate for the pedimento is the one published by Banco de Mexico in the Official Gazette on the business day immediately prior to the goods' entry into national territory (or their presentation to customs). Using a different exchange rate is grounds for pedimento rejection or subsequent adjustments.
Each different type of merchandise within the same shipment is declared as a separate line item on the pedimento. If you import 5 different products in one container, your pedimento will have 5 line items. Each line item contains detailed merchandise information allowing authorities to identify, value, and apply the corresponding regulations.
The tariff classification for each line item is the most critical piece of data on the pedimento. An incorrect classification can result in: incorrect duty payments, non-compliance with non-tariff regulations, loss of trade agreement benefits, and fines of 70% to 100% of the goods' value. Tools like Camtom can verify tariff classification consistency before pedimento validation.
There are more than 40 pedimento codes covering different types of customs operations. The correct code determines the applicable tax regime, required documents, and subsequent obligations. The most commonly used codes are as follows.
It is the customs broker's responsibility to select the correct pedimento code, but the importer should verify it corresponds to the type of operation being performed. An incorrect code can generate everything from undue tax payments to legal problems for illegal importation.
The pedimento is the document where all foreign trade contributions are settled (calculated and paid). Each contribution has its own base, rate, and specific calculation method. The liquidation section of the pedimento presents the complete breakdown.
VAT base = Customs value + Import duty + Customs processing fee + Countervailing duties. VAT = Base x 16%. Example: If customs value is $100,000, import duty is $10,000, customs processing fee is $800, and there are no countervailing duties: VAT = ($100,000 + $10,000 + $800) x 16% = $17,728.
Article 36-A of the Customs Law establishes the documents that must be electronically transmitted along with the pedimento through Mexico's Single Window for Foreign Trade Procedures, VUTCE (formerly VUCEM). These documents are indispensable for clearance and must be digitized and associated with the pedimento before validation.
Document digitization has significantly streamlined the customs clearance process in Mexico. However, it has also increased the responsibility of importers and customs brokers to maintain complete and correct digital files, as authorities can verify these documents at any time during the 5 years following the operation.
For importers receiving a pedimento from their customs broker, knowing how to read and interpret it is fundamental for detecting errors before they become problems. Follow these steps to review your pedimento effectively.
Always request a pre-validation of the pedimento from your customs broker before they transmit it to the SAAI system. It is easier to correct errors before validation than after. Once validated and paid, changes require an amendment procedure that can be time-consuming and costly.
Errors on pedimentos occur more frequently than desired. The Customs Law provides amendment mechanisms to correct incorrect data, but with certain limitations and deadlines. Amendments are made by filing a new amendment pedimento (code R1) that modifies specific fields of the original pedimento.
The best strategy is always prevention: carefully review the pedimento before validation, maintain fluid communication with the customs broker, and use technology tools that automate verification of critical data such as tariff classifications, values, and exchange rates.
