A customs broker (agente aduanal) is an individual authorized by Mexico's Tax Administration Service (SAT) through a patent to promote customs clearance of goods on behalf of third parties. They are the legal intermediary between the importer or exporter and customs authorities, responsible for correctly classifying goods, determining customs value, calculating duties, preparing the pedimento (customs declaration), and representing the importer before customs.
The customs broker figure is regulated by Articles 159 through 165 of Mexico's Customs Law. The role is personal in nature (the patent is non-transferable) and requires specialized technical training including knowledge of tariff classification, customs valuation, non-tariff regulations, free trade agreements, and tax and customs legislation. The SAT grants patents through a selection process that includes knowledge examinations and solvency requirements.
There are approximately 1,700 active licensed customs brokers in Mexico. Since the 2018 reform, customs agencies (legal entities) also exist, offering the same services but with a corporate structure. Both figures are equally valid for promoting customs clearance.
The customs broker is jointly liable with the importer for the accuracy of data declared on the pedimento, including tariff classification, customs value, and duties. This means that if there is an error, both the broker and importer can be penalized. The exception is when the broker acted based on false information provided by the importer.
The 2018 Customs Law reform introduced customs agencies (agencias aduanales) as legal entities authorized to promote customs clearance. This represented a significant change in a sector that for decades was exclusive to individuals with patents.
Choosing a customs broker or agency is one of the most important decisions for a foreign trade company. A good broker can mean efficient clearance, correct compliance, and tax optimization; a poor one can generate delays, fines, and legal contingencies.
The cheapest broker is not always the best. A tariff classification error can cost penalties of 70% to 100% of goods value, far more than the fee difference between a competent and economical broker. Evaluate the comprehensive value of the service.
The relationship between the importer and customs broker is collaborative. The importer has obligations to fulfill so the broker can perform their work correctly.
The importer's failure to meet these obligations may exempt the customs broker from joint liability. If the importer provides false or incomplete information resulting in an incorrect pedimento, responsibility falls exclusively on the importer.
The customs broker profession is undergoing a profound transformation driven by technology. Artificial intelligence, blockchain, and automation tools are changing how foreign trade operations are conducted.
Far from disappearing, the future customs broker will be more of a strategic foreign trade consultant than a processor. Mechanical tasks will be automated, but regulatory analysis, tax optimization, and risk management will continue to require expert human judgment.
