A binding ruling is a written decision by CBP that provides the official tariff classification, country of origin, or valuation treatment for a specific product. Under 19 CFR Part 177, CBP is legally bound by its rulings — meaning that if you classify your product according to a valid binding ruling, CBP cannot assess penalties for that classification, even if they later change their interpretation. This legal certainty is invaluable for high-value or ambiguous products.
Ruling requests are filed electronically through the eRulings system on the CBP website. The request must include a complete product description (including technical specifications, composition, and intended use), product samples if available, your proposed HTS classification with supporting rationale, any relevant commercial documentation (brochures, technical data sheets, lab analyses), and a statement of any prior rulings you are aware of covering similar products.
CBP assigns the request to a National Import Specialist (NIS) with expertise in the product category. The NIS may request additional information, product samples, or lab analysis before issuing the ruling. The process typically takes 30-120 days, though complex cases can take longer.
CBP’s Customs Rulings Online Search System (CROSS) at rulings.cbp.gov contains over 250,000 binding and informed compliance rulings. Before requesting a new ruling, search CROSS for existing rulings on similar products. These rulings provide authoritative classification guidance and can be cited in your own ruling request to support your proposed classification.
